BlueLaVaMedia has adopted this Privacy Policy to inform you that it collects Personal Information when you use the Services and to explain how it is used. This Privacy Policy applies to online interactions and does not cover offline data practices. Communications Data. We may collect and process information relating to your email and SMS communications with us, booking and scheduling activity, marketing preferences, and customer-support requests, to provide and improve the Services, respond to requests, maintain security, and comply with legal obligations.
We collect Personal Information directly from you, automatically through your use of our website, and from third parties. Third-party sources may include MLS systems, real estate brokerages, scheduling platforms, marketing platforms, social media platforms, advertising partners, and referral sources.
The Website uses cookies, pixel tags, web beacons, and similar tracking technologies to operate the site, deliver features, analyze usage, and support analytics and advertising. Opt-In and Consent. By providing your mobile phone number and checking the consent box on one of our website forms, you expressly consent to receive SMS text messages from BlueLaVaMedia regarding appointment confirmations, scheduling updates, photography job notifications, project status updates, billing notices, customer service communications, service announcements, and other communications related to the services you request. Providing consent is voluntary and is not a condition of purchasing any BlueLaVaMedia service. Message frequency may vary, and standard message and data rates may apply. Mobile Information Sharing. Mobile phone numbers, SMS opt-in information, and SMS consent will not be shared with third parties or affiliates for marketing or promotional purposes. We may share your mobile number only with trusted service providers that assist us in delivering SMS communications or providing services on our behalf, and those providers are contractually obligated to protect your information and may not use it for any other purpose.
We share Personal Information with service providers that assist with hosting, scheduling, payment processing, email and SMS delivery, analytics, and media delivery, under contractual obligations to protect it and use it solely on our behalf; with our affiliates, successors, and assigns; in connection with a business transaction; to respond to lawful requests by government authorities, a court order, or a subpoena; to protect our personnel and users; and to prevent fraud or the violation of law. We do not sell your Personal Information for monetary consideration. To the extent advertising or analytics technologies constitute a sale or sharing for cross-context behavioral advertising under applicable law, you may opt out through the cookie consent manager or by submitting a request as described below.
Third-party service providers maintain their own independent privacy policies, and we encourage you to review them. Even if we delete your Personal Information, it may remain in a third-party provider’s database. We have no responsibility for the collection, use, or storage activities of third parties, or for the content of third-party websites linked from the Website. We do not directly store your full payment card information; payments are processed by a secure, PCI DSS-compliant third-party payment processor solely to complete your transaction.
BlueLaVaMedia primarily serves customers located in northern Michigan and throughout the United States. Your Personal Information is stored and processed on computers and servers in the United States, and regardless of where it is stored, we apply the protections described in this Privacy Policy. By using the Services, you consent to the transfer, storage, and processing of your Personal Information in the United States.
We retain Personal Information only for as long as reasonably necessary to provide the Services, maintain business records, comply with legal obligations, resolve disputes, enforce our agreements, and protect our business interests, unless a longer period is required or permitted by law. When no longer required, we securely delete or anonymize it. You may request deletion as described below.
We implement commercially reasonable administrative, technical, and physical safeguards designed to protect Personal Information from unauthorized access, use, disclosure, alteration, or destruction, including encryption of data in transit and at rest and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You provide information at your own risk.
Many of our services involve photographing or marketing properties. Property photographs, videos, floor plans, virtual tours, and related media may contain information visible from public or private areas of a property. Clients are responsible for ensuring that any sensitive, confidential, personal, or proprietary information they do not wish to appear in marketing materials is removed or concealed prior to the scheduled appointment.
The Services are intended for business and professional use and are not directed to users under the age of eighteen (18). BlueLaVaMedia does not knowingly collect Personal Information from anyone under eighteen (18). If we discover that we have collected Personal Information from a minor under eighteen (18), we will promptly delete it.
Depending on your jurisdiction and applicable law, you may have rights with respect to your Personal Information, including the rights of access, correction, deletion, restriction of processing, data portability, and objection, as described below. BlueLaVaMedia may purchase other businesses or sell components of its business. In that event, your Personal Information will continue to be used consistent with this Privacy Policy, and we will provide notice before your Personal Information becomes subject to a materially different policy.
